IDAHO TAEKWONDO TRAINING CENTER ADDENDUM TO WAIVER OF LIABILITY
COVID-19 WAIVER OF CLAIMS AND INDEMNITY
IN CONSIDERATION for my being permitted to utilize the services, programs, and premises provided by Idaho Taekwondo Training Center (“ITTC”), including but not limited to observation and general use of the equipment and/or facilities.
The undersigned, on behalf of himself or herself, family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives (hereinafter referred to as “the undersigned”), hereby recognizes that because ITTC is open for use by other individuals, he or she is at higher risk of being exposed to or contracting SARS-CoV-2 (“COVID-19”) by entering the premises and/or availing themselves of ITTC resources. The undersigned understands that such exposure or infection by COVID-19 at ITTC may result in personal injury, illness, permanent disability, and/or death and that the risk of becoming exposed to or infected by COVID-19 at ITTC may result from the actions, omissions, or negligence of the himself or herself and others, including, but not limited to ITTC employees, volunteers, program participants, their families, and participants and affiliates of other programs operating on ITTC premises.
The undersigned agrees he or she is personally responsible for his or her own actions at all times while present at ITTC premises and during any offsite activity undertaken in conjunction with ITTC. The undersigned agrees he or she will comply with all ITTC policies and rules, including but not limited to all ITTC agreements, procedures, guidelines, signage, and instructions. The undersigned acknowledges that should he or she fail to follow ITTC policies and rules, he or she may be liable for knowingly placing others at increased risk of being exposed to or contracting COVID-19.
With full awareness and appreciation of the risks involved, the undersigned hereby forever release, waive, discharge, and covenant not to sue ITTC, its agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by the undersigned related to COVID-19 while participating in or observing any activity at ITTC and/or while using any ITTC facilities or equipment.
The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury specifically related to COVID-19 arising from or related to the undersigned’s participation in or observation of any activity at ITTC and/or from the undersigned’s use of ITTC facilities, equipment, or premises, whether or not caused by the negligence of the Released Parties.
By signing below, the undersigned acknowledges and represent that:

The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury specifically related to COVID-19 arising from or related to the undersigned’s participation in or observation of any activity at ITTC and/or from the undersigned’s use of ITTC facilities, equipment, or premises, whether or not caused by the negligence of the Released Parties.
By signing below, the undersigned acknowledges and represent that:
- I have read the foregoing Addendum to ITTC’s existing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document.
- I am sufficiently informed about the risks involved in availing myself of ITTC services and ITTC facilities to decide whether to sign this document.
- I understand that this Addendum Waiver of Liability is a supplement to ITTC’s existing Waiver of Liability. Should the two waivers be found in conflict, this Addendum shall govern.
- No oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document in consideration for being permitted to utilize the services, programs, and premises provided by ITTC, fully intending to be bound by the same.
- I agree that this Addendum Wavier of Liability and Indemnification shall be governed by and construed in accordance with Idaho law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole.
